Referral Program Terms and Conditions

Thank you for your interest in the Call Experts Referral Program. Please read these Terms and Conditions carefully before participating. By participating in the program, you agree to be bound by these Terms and Conditions.

1. Eligibility

The Call Experts Referral Program (“Program”) is open to any active Call Experts client, employee, or other approved participant who is a resident of the United States or Canada and is eighteen (18) years of age or older.

2. Non-Exclusive Program; No Agency

Participation in this Program is non-exclusive. Participation does not create any partnership, joint venture, employment, franchise, or agency relationship between you and Call Experts. You have no authority to bind Call Experts, act on its behalf, or make any representation, warranty, or commitment for or in the name of Call Experts.

3. How to Make a Referral

To participate in the Program, you must refer a prospective new customer to Call Experts by:

(a) emailing their contact information to info@callexperts.com; or
(b) directly connecting the prospect with a Call Experts sales representative or client success representative.

By submitting a referral, you represent and warrant that you have obtained any necessary permission or consent from the referred person or company to share their contact information with Call Experts or to connect them with a Call Experts representative for business outreach.

4. Qualified Referral

A referral bonus will only be paid for a “Qualified Referral.” A Qualified Referral is a referred customer that, as determined by Call Experts in its sole discretion:

(a) is a new customer to Call Experts and not an existing or former customer;
(b) was not already in active discussions, solicitation, or sales process with Call Experts at the time of referral;
(c) is referred in accordance with these Terms and Conditions;
(d) executes a services agreement with Call Experts;
(e) pays for services; and
(f) remains an active customer in good standing for at least ninety (90) days after signing up.

Call Experts reserves the sole right to determine whether any referral qualifies as a Qualified Referral.

5. Referral Bonus

For each Qualified Referral, the referring participant will receive a $250 referral bonus. The referral bonus may be issued, at Call Experts’ sole discretion, in the form of either:

(a) a $250 Amazon gift card; or
(b) a $250 credit to the participant’s Call Experts account, where applicable.

Employees are eligible to receive the referral bonus in the form of an Amazon gift card.

The referral bonus will be issued only after the Qualified Referral has remained an active customer in good standing for ninety (90) days.

Only one referral bonus will be paid per Qualified Referral, regardless of the number of persons or entities claiming the referral.

6. Referral Bonus Restrictions

Referral bonuses are non-transferable, have no cash value except as expressly determined by Call Experts, and may not be redeemed or exchanged for cash. Call Experts may withhold, deny, or cancel any referral bonus if it determines, in its sole discretion, that:

(a) the referral was fraudulent, misleading, deceptive, or otherwise improper;
(b) the referral did not meet the requirements of a Qualified Referral;
(c) the referred customer cancels, defaults, or fails to remain in good standing within the first ninety (90) days;
(d) the participant violated these Terms and Conditions; or
(e) the bonus was issued in error.

7. Ineligible Referrals

The following referrals are not eligible for any referral bonus unless expressly approved in writing by Call Experts:

(a) self-referrals;
(b) referrals of any affiliate, parent, subsidiary, commonly controlled entity, or related party of the participant;
(c) referrals generated through spam, deceptive marketing, unsolicited bulk messaging, or unlawful conduct; and
(d) referrals submitted without the referred party’s consent where consent is required.

8. No Use of Call Experts Branding

You may not use Call Experts’ name, logo, trademarks, service marks, marketing materials, or other branding in any advertisement, website, social media post, email campaign, solicitation, or promotional material without Call Experts’ prior written consent.

You may not hold yourself out as a representative, partner, broker, or authorized agent of Call Experts, except that employees acting within the scope of their employment may describe Call Experts and its services in the ordinary course of business.

9. Compliance With Law

You agree that any participation in the Program will comply with all applicable federal, state, provincial, and local laws, rules, and regulations. You may not engage in deceptive, misleading, unlawful, or unsolicited mass marketing practices in connection with the Program. This Program is void where prohibited by law.

10. Call Experts’ Discretion and Customer Acceptance

Call Experts reserves the sole right to determine whether to contact, pursue, accept, or contract with any referred prospect. Call Experts has no obligation to accept any referred party as a customer and will not be liable for declining to do so.

11. Program Limits

There is currently no set limit on the number of referrals you may submit; however, Call Experts reserves the right, in its sole discretion, to limit the number of referrals submitted by any participant or the number of referral bonuses paid to any participant.

12. Modification, Suspension, or Termination of Program

Call Experts reserves the right to modify, suspend, or terminate this Program at any time, in its sole discretion. Any such change will apply prospectively and will not affect referral bonuses that were already earned prior to the effective date of the change, except in cases of fraud, error, ineligibility, or violation of these Terms and Conditions.

13. Privacy

By participating in the Program, you agree that Call Experts may collect, use, store, and process your personal information and referral-related information for the purpose of administering the Program, verifying eligibility, communicating regarding referrals, and issuing referral bonuses.

14. Taxes

You are solely responsible for any federal, state, local, provincial, or other taxes arising from your receipt of a referral bonus. Call Experts may issue any tax reporting forms required by applicable law.

15. Disclaimer of Liability

Call Experts shall not be liable for any acts, omissions, statements, conduct, or representations made by any participant or referred party in connection with this Program. Call Experts makes no guarantee that any referred prospect will become a customer or that any participant will receive any referral bonus.

To the fullest extent permitted by law, Call Experts shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to this Program.

16. Governing Law and Venue

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of laws principles. Any dispute arising out of or relating to this Program shall be brought exclusively in the state or federal courts located in South Carolina, and each participant consents to the personal jurisdiction and venue of such courts.

17. Entire Agreement

These Terms and Conditions constitute the entire agreement between you and Call Experts with respect to the Program and supersede any prior or contemporaneous communications, understandings, or representations relating to the Program.
